Willie Sandlin Pool Party Reservation Agreement


Reservation of the Willie Sandlin Pool constitutes acceptance of all pool rules, policies,

and the terms of this Pool Rental & Liability Agreement.

By reserving the Willie Sandlin Pool, the Renter acknowledges that they have read, understand, and agree to abide by all pool rules, policies, and the terms of this Pool Rental & Liability Agreement.

WILLIE SANDLIN POOL

POOL RENTAL & LIABILITY AGREEMENT

​

This Agreement is entered into by and between:

Leslie County Fiscal Court, owner of the Willie Sandlin Pool (“Owner”),
Big Creek Missions, Inc., a Kentucky nonprofit corporation, operator of the Willie Sandlin Pool (“Operator”),
Kevin Rogers, Pool Manager (“Manager”),
and the undersigned Renter / Responsible Party (“Renter”).

This Agreement governs private pool rentals and party reservations at the Willie Sandlin Pool.

1. Facility Ownership and Operation

The Willie Sandlin Pool is owned by the Leslie County Fiscal Court and operated by Big Creek Missions, Inc. Kevin Rogers serves as Pool Manager on behalf of Big Creek Missions.

2. Facility Use Period

The pool operates in two distinct periods:

• Public Swim Hours, open to the general public
• Private Rental Hours, which begin only after public swimming has closed and lifeguards signal entry for the rental group

This Agreement applies only to Private Rental Hours. Renter and guests may not enter the pool deck until public swimming has ended and lifeguards give permission to enter.

3. Assumption of Risk

Renter acknowledges that swimming and pool activities involve inherent risks, including but not limited to slips, falls, drowning, physical injury, emotional injury, or death. Renter voluntarily assumes all risks for themselves and their guests.

4. Release and Waiver of Liability

In consideration for being permitted to use the Willie Sandlin Pool, Renter, on behalf of themselves and their participants, guests, heirs, assigns, and representatives, hereby releases and forever discharges:

Leslie County Fiscal Court,
Big Creek Missions, Inc.,
Kevin Rogers, Pool Manager,
and all respective officers, employees, volunteers, agents, and representatives
(collectively, the “Released Parties”)

from any and all claims, demands, actions, causes of action, damages, injuries, losses, or liabilities of any kind, whether known or unknown, arising from or related to use of the pool or participation in pool activities, including claims arising from the negligence of the Released Parties, except for willful or wanton misconduct as defined by Kentucky law.

Renter understands that this release is intended to be as broad and inclusive as permitted by Kentucky law.

5. Indemnification

Renter agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, damages, losses, or expenses (including reasonable attorney’s fees) arising out of:

• Renter’s use of the facility
• Actions of Renter’s guests or participants
• Violation of pool rules
• Damage to property
• Injury to any participant or third party during Renter’s reservation

6. Supervision of Minors

Renter accepts full responsibility for supervision of minors in their group. One adult is required per three children under age 13. Renter certifies they are the parent or legal guardian of minor participants or have obtained permission from a parent or guardian.

7. Medical Authorization

Renter authorizes pool staff or management to obtain emergency medical treatment for any participant if reasonably necessary and agrees to be financially responsible for such treatment.

​

8. Insurance and Governmental Immunity

Owner and Operator maintain general liability insurance for pool operations. Nothing in this Agreement shall be interpreted as a waiver of any governmental immunity or statutory protections available to Leslie County Fiscal Court under Kentucky law.

9. Rules and Conduct

All posted pool rules must be followed. Lifeguards and the Pool Manager have full authority to enforce rules. Failure to comply may result in removal from the facility without refund.

Key rules include but are not limited to:

• No alcohol, smoking, vaping, or drugs on premises
• No glass containers
• No profanity or disorderly conduct
• Proper swim attire required
• Swim diapers required for non-potty-trained children
• No running or rough play
• No diving except in designated areas
• Lifeguard instructions must be obeyed

Kentucky State Health Regulation:
If fecal contamination occurs in the pool, the pool must be closed for the remainder of the rental period with no refund. This requirement is mandated by Kentucky public health regulation and cannot be waived.

10. Damage and Cleanup

Renter is responsible for cleanup and for any damage to pool property or equipment caused by Renter or their guests.

​

11. Cancellations and Weather

• Operator may cancel reservations due to unsafe weather or facility conditions, resulting in full refund.
• Renter must provide at least 7 days’ notice for full refund.
• If severe weather disrupts more than 50% of rental time, Renter may receive a 50% refund or reschedule.

12. Rental Fee

Pool rental rate is $110 for two hours. Reservations and changes must be made during normal pool operating hours.

​

13. Governing Law and Venue

This Agreement shall be governed by and interpreted under the laws of the Commonwealth of Kentucky. Any legal action related to this Agreement shall be filed in Leslie County, Kentucky.

​

14. Entire Agreement

This document constitutes the entire agreement regarding pool rental and liability and supersedes any prior verbal or written agreements.

15. Acceptance

Reservation of the Willie Sandlin Pool constitutes acceptance of all pool rules, policies, and the terms of this Pool Rental & Liability Agreement.   By reserving the Willie Sandlin Pool, the Renter acknowledges that they have read, understand, and agree to abide by all pool rules, policies, and the terms of this Pool Rental & Liability Agreement.
